Terms & Conditions

1. Acceptance of Terms

By engaging with MG Management Solutions (Pty) Ltd ("the Firm"), you agree to be bound by these Terms and Conditions. These terms apply to all services rendered by the Firm.

2. Services

The Firm provides accounting, tax, payroll, and related financial services. The specific services rendered will be as agreed upon in writing between the client and the Firm. Services are subject to a written engagement letter.

3. Client Responsibilities

Clients are responsible for providing accurate, complete, and timely information required for the Firm to perform its services. The Firm shall not be liable for errors or penalties resulting from incorrect or incomplete information provided by the client.

4. Fees & Payment

Fees are agreed upon in the engagement letter and are payable on the terms specified therein. The Firm reserves the right to suspend services in the event of non-payment. All fees are exclusive of VAT unless otherwise stated.

5. Confidentiality

The Firm maintains strict confidentiality of all client information in accordance with the Protection of Personal Information Act (POPIA) and applicable professional standards. Client information will not be disclosed to third parties without prior written consent, except where required by law.

6. Limitation of Liability

The Firm's liability is limited to the fees paid by the client for the specific service giving rise to the claim. The Firm shall not be liable for indirect, consequential, or incidental damages.

7. Intellectual Property

All work products, methodologies, and materials developed by the Firm remain the intellectual property of the Firm unless otherwise agreed in writing.

8. Termination

Either party may terminate the engagement by providing 30 days' written notice. Outstanding fees remain due and payable upon termination.

9. Governing Law

These terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the South African courts.

Privacy Policy

1. Information We Collect

We collect personal information including but not limited to: name, contact details, financial information, tax numbers, and company details necessary to provide our services. This is collected in compliance with the Protection of Personal Information Act (POPIA) No. 4 of 2013.

2. How We Use Your Information

Personal information is used solely for the purpose of providing agreed services, complying with legal obligations, communicating with you regarding our services, and improving our service delivery.

3. Information Security

We implement appropriate technical and organisational measures to protect your personal information against unauthorised access, alteration, disclosure, or destruction. All staff are bound by confidentiality agreements.

4. Sharing of Information

We do not sell, trade, or transfer personal information to third parties. Information may be shared with SARS, CIPC, and other regulatory bodies as required by law in the course of providing our services.

5. Your Rights (POPIA)

You have the right to: access your personal information, request correction of inaccurate information, request deletion of your personal information (subject to legal retention requirements), and object to the processing of your personal information.

6. Retention of Records

We retain client records for the period required by applicable legislation, including the Income Tax Act, Companies Act, and SAIPA professional standards. Records are securely destroyed thereafter.
